What is a tariff?
Tariff means a publication containing the actual rates, charges, classifications, rules, regulations and practices of a common carrier or a conference of common carriers. The term “practices” refers to those usages, customs or modes of operation which in any way affect, determine or change the transportation rates, charges or services provided by a common carrier or conference and, in the case of conferences, must be restricted to activities authorized by the basic conference agreement. (46 CFR § 520.2)
Who must publish a tariff?
All NVOCCs operating in the U.S. trades are required to publish a tariff (46 CFR § 520.3)
When must a tariff be published?
Tariffs must be published prior to a license being issued, and prior to commencement of services, a NVOCC must provide the Commission its organization name, home office address, name and telephone number of firm’s representative, the location of its tariff(s), and the publisher used to maintain its tariff(s), and submit this information using Form FMC-1. (46 CFR § 520.3(d))
